These Terms & Conditions (“Terms of Use” or “Terms”) govern your access to and use of the AgeWell DNA website located at https://agewelldna.com, any associated mobile applications, and all related features, content, products, and services (collectively, the “Service”), operated by AgeWell DNA (“Company,” “we,” “us,” or “AgeWell DNA”), based in Tampa, Florida.

By accessing, browsing, registering for, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, along with any policies referenced herein, including our Privacy Policy. If you do not agree to these Terms, you must immediately discontinue use of the Service.

NOTICE OF ARBITRATION & CLASS ACTION WAIVER

These Terms include an arbitration agreement and class action waiver. You agree that any dispute with AgeWell DNA will be resolved through binding arbitration on an individual basis, and you waive any right to participate in a class or representative action.

The Service is intended for individuals 18 years of age or older. By using the Service, you represent and warrant that you are at least 18 years old, or that you are the parent, legal guardian, or authorized legal representative for the individual whose DNA sample or data is being provided.

MODIFICATION OF TERMS

AgeWell DNA reserves the right to modify these Terms at any time. Updated Terms will be posted on the Service with a revised “Last Updated” date. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

SERVICE ACCESS & USE

AgeWell DNA grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial use only.

You agree not to reproduce, distribute, modify, reverse engineer, resell, or exploit any portion of the Service without prior written consent. You agree not to misuse the Service, interfere with its operation, attempt unauthorized access, or violate any applicable laws.

NO MEDICAL RELATIONSHIP

Use of the Service does not create a physician-patient relationship or any other professional healthcare relationship between you and AgeWell DNA. AgeWell DNA assumes no responsibility for medical decisions or outcomes.

THIRD-PARTY PRODUCTS & SERVICES

The Service may reference or link to third-party products or services. AgeWell DNA does not endorse or guarantee any third-party offerings and is not responsible for their quality, accuracy, or performance.

ACCOUNTS, PAYMENTS & PURCHASES

To access certain features, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials.

All purchases are payable in advance. Prices, taxes, and fees may vary. Orders are shipped to the address provided during checkout.

REFUNDS, RETURNS & CANCELLATIONS

DNA test kits:
– Orders may be canceled only before shipment.
– Once shipped, unused kits may be eligible for return within 30 days, subject to approval and less shipping and handling costs.
– Used DNA kits are non-refundable.

DNA reports from uploaded third-party data:
– Once reports are accessed or viewed, no refunds will be issued.

Supplements:
– Custom or personalized supplements are non-refundable once production begins or shipment occurs.
– Certain non-custom supplements may be eligible for return within 30 days if unused.

All refund requests must be submitted to info@agewelldna.com and are issued to the original payment method if approved.

SMS / MOBILE MESSAGING TERMS

By opting into AgeWell DNA text messaging, you consent to receive marketing or informational messages. Message and data rates may apply. Consent is not required for purchase.

You may opt out at any time by replying STOP. Support is available at info@agewelldna.com.

INTELLECTUAL PROPERTY

All content, trademarks, logos, reports, software, and materials provided through the Service are owned by or licensed to AgeWell DNA and protected by intellectual property laws. Unauthorized use is prohibited.

Any feedback, suggestions, or ideas you provide become the property of AgeWell DNA, and you grant us a perpetual, royalty-free right to use such feedback without compensation.

TERMINATION

AgeWell DNA may suspend or terminate your access to the Service at any time, with or without notice, for any violation of these Terms or for any reason deemed appropriate.

INDEMNIFICATION

You agree to indemnify and hold harmless AgeWell DNA and its affiliates from any claims, damages, losses, or expenses arising from your use of the Service, violation of these Terms, or infringement of any rights.

DISCLAIMER OF WARRANTIES

s available,” and “with all faults.” AgeWell DNA disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

LIMITATION OF LIABILITY

To the fullest extent permitted by law, AgeWell DNA shall not be liable for indirect, incidental, consequential, or punitive damages. Total liability shall not exceed the greater of $100 or the amount paid by you to AgeWell DNA in the twelve months preceding the claim.

GOVERNING LAW & JURISDICTION

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any permitted court actions shall be brought exclusively in state or federal courts located in Florida.

ARBITRATION AGREEMENT

Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in Florida, governed by the Federal Arbitration Act.

You agree to arbitrate disputes on an individual basis only and waive any right to class arbitration or class actions.

SEVERABILITY

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.

ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and AgeWell DNA regarding the Service and supersede all prior agreements or understandings.
